Medical cannabis has been legal in Ohio for a few years now, but we all know the laws and guidelines surrounding it are anything but common knowledge. At Body and Mind medical marijuana dispensary in Cleveland, we want our patients to be safe and aware of laws and regulations. If you’re a medical patient, you still have to be careful about where and when you consume your medicine, especially while driving.
As restrictions surrounding medical cannabis use continue to evolve, it’s important to play it safe. Don’t consume medical marijuana while operating any motor vehicles. We’ve put together some more information surrounding the subject to help educate our local community about current Ohio laws and regulations.
What does Ohio Law Say?
The State of Ohio prosecutes drivers for cannabis related DUI/OVI (Operating a Vehicle Impaired).
The first thing to understand is the difference between the two types of OVI. The first and most common is OVI impaired, which is pretty much what it sounds like; you get pulled over obviously under the influence of cannabis or other drugs. In an instance like this, an officer will conduct what we know as a ‘field sobriety test’. This situation may result in prosecution.
The second and lesser-known type of OVI is an OVI per se. It’s a highly contested way to prove wrongdoing. There is disagreement among the scientific community regarding what amount of marijuana impairs a person’s driving ability and the way Ohio does testing, marijuana metabolites are often caught on a test days or weeks after the effects have worn off.
We all know what THC is, but many of us don’t know there are two key factors as it relates to staying in our bloodstream. One of the metabolites, Hydroxy THC, is an active metabolite and is detectable for about three hours. Another metabolite, Carboxy THC, is an inactive metabolite and is detectable for up to five weeks.
The law makes it illegal to operate a vehicle with a prohibited concentration of marijuana metabolite, which is currently listed at 35 nanograms per milliliter of urine and 50 nanograms per milliliter of blood.
